Miles de trabajadores, una sentencia y muchas dudas

El Tribunal Supremo ha cerrado la puerta a que, con carácter general, los empleados públicos que hayan sufrido un encadenamiento abusivo de contratos temporales puedan convertirse en fijos sin haber superado un proceso selectivo. En una sentencia hecha pública este martes, el pleno de la Sala de lo Social sostiene que permitir esa conversión vulneraría los principios constitucionales de igualdad, mérito y capacidad, además de impedir el acceso al empleo público al resto de ciudadanos. “La contratación temporal (…) sin superar un procedimiento de acceso al empleo público (…) no permite que esos trabajadores adquieran la condición de fijos”, señala el fallo.
No obstante, el alto tribunal sí admite la conversión en fijos en un supuesto muy concreto: el de aquellos trabajadores que hayan participado en una oposición o un concurso-oposición con pruebas eliminatorias, hayan demostrado su capacitación y, pese a ello, no hayan obtenido plaza por falta de vacantes, continuando posteriormente con contratos temporales de forma abusiva. Quedan así excluidos los empleados que accedieron mediante concursos de méritos, bolsas de trabajo u otros procesos sin pruebas eliminatorias.
La sentencia se dicta en consonancia con el pronunciamiento del Tribunal de Justicia de la Unión Europea del pasado 14 de abril, que cuestionó si la normativa española sanciona adecuadamente el abuso de la temporalidad en el sector público. Frente a esa crítica, el Supremo considera que las medidas adecuadas pasan por el pago de indemnizaciones y por la remisión del caso a la Inspección de Trabajo para que inicie procedimientos sancionadores. El Gobierno, por su parte, interpreta el fallo como una ratificación de la doctrina ya consolidada por el propio tribunal y alineada con el criterio del Tribunal Constitucional.
