¿Cómo es posible que dos hermanos inocentes lleven cuatro años en prisión condenados a 26 años por un crimen que no cometieron? Hoy en Penitencia, Saskia Niño de Rivera habla con Francisco Gutiérrez, el abogado que tomó el caso de los hermanos Heredia después de leer un expediente que le dejó una sola pregunta: ¿cómo llegaron hasta aquí?
Los hermanos Heredia bajaron a auxiliar a un vecino que escucharon en problemas. En medio de la pelea uno de ellos resultó herido y fueron llevados por un transeúnte a un hospital privado de Iztapalapa. Ahí despertaron esposados. La acusación: homicidio calificado. La sentencia: el máximo de la ley.
Francisco reconstruye, paso a paso, todo lo que salió mal: un abogado que les aconsejó guardar silencio desde los separos, un juicio oral en el que no se les permitió hablar, un juez que nunca aceptó incorporar pruebas de la defensa, un proceso de apelación en el que los magistrados se lavaron las manos, y una Fiscalía que, al ver tres personas en la escena y un occiso, decidió que todos eran culpables sin investigar más.
En este episodio también se explora lo que sucede cuando el sistema penal se deshumaniza por sobrecarga: abogados de oficio con cinco audiencias diarias sin tiempo de estudiar los expedientes, ministerios públicos con 250 carpetas que ya no ven personas sino números, y el trauma vicario que nadie atiende en quienes trabajan la justicia desde adentro.
Francisco explica cuál es la última oportunidad de los Heredia: un amparo directo. Si el proceso se reabre, habrá un testigo clave dispuesto a declarar que los hermanos entraron a auxiliar, no a agredir. Mínimo dos años más de espera. Su madre, Sara, sigue yendo cada jueves al reclusorio.
